Disposable Vape Ban: What Is It & How Will It Work?

The increase in single-use vapes became a huge fire hazard for the waste industry in England and Wales. In response, the UK government introduced the Environmental Protection (Single-use Vapes) (England) Regulations 2024, which came into effect on June 1st 2025.

As Brown Recycling offers specialist vape containers, we’re here to help businesses and retailers understand the new disposable vape ban and manage vape waste responsibly, to ensure they’re fully compliant.

What is the disposable vape ban?

The new  legislation prohibits the manufacture, sale, supply, and storage of any single-use (disposable) vapes in England. This includes any vape products that aren’t made to be refilled or recharged.

Refillable, rechargeable and modular vape kits still remain legal, as they pose a lesser environmental risk. Retailers should not be selling, giving away or advertising disposable vapes. Anyone found to be failing to comply with the new rules risks prosecution under environmental and consumer protection legislation.

Why was it introduced?

The ban was introduced in response to the rapid rise in vape waste. According to Material Focus, UK consumers are discarding around 5 million vapes each week. The vast majority of the vape waste is ending up in general waste or litter. The danger of this is that lithium-ion cells can easily ignite when collected in waste trucks and bins.

This new legislation is designed to stop as many people from vaping as possible, especially younger people attracted to the flavours and colours. Those who wish to continue vaping must switch to refillable kits.

Now that the June 2025 date has passed, there should be a dramatic shift away from public responsibility due to the supply being cut off. The focus instead is now on disposing of leftover stock. However, retailers and businesses should still provide recycling collection points for people to get rid of existing single-use vapes purchased before the ban, making vape containers as crucial as ever.

What does the ban mean for retailers and businesses?

Here is what you need to do if you’re a retailer or a business:

  • Remove disposable vapes from sale and label them as unsellable
  • Update staff on the rules and regulations, clearly defining single-use vapes
  • Segregate leftover units for collection and specialist disposal as WEEE waste
  • Arrange for compliant collection through a licensed recycler
  • Offer an in-store take-back scheme using a vape container to accept used vapes and parts for recycling if you are a retailer
  • Keep invoices and product specifications as evidence to prove that any vapes you do sell are reusable/refillable
